Garry AI Product Terms

1. Who operates Garry AI

1.1 Garry AI is offered within the CUE platform by ASTRUMEROLOGY LLC, doing business as CUE. A CUE account is used to access Garry AI and related CUE experiences.

1.2 Gary S. Grinberg, known as Gary the Numbers Guy, and 28 STREET LLC license approved name, likeness, voice, methodology, recordings, teachings, source materials, and related content for use in Garry AI. Gary does not personally prepare, review, approve, or endorse every generated response.

1.3 Garry AI is not Gary, is not sentient, and is not a live conversation, private consultation, professional engagement, or personal reading with Gary unless a separate written offer expressly states otherwise.

2. What Garry AI provides

2.1 Garry AI uses artificial intelligence to provide educational, informational, and entertainment experiences inspired by approved teachings and materials. Features may address numerology, astrology, timing, relationships, sports, markets, personal reflection, and related topics.

2.2 The product may include text chat, voice interactions, generated speech, prompt libraries, restricted prompts, tier based knowledge, personalization, and future capabilities. Available features depend on the plan, eligibility, region, provider availability, device, and current product configuration.

2.3 Garry AI is an evolving digital service. Models, providers, prompts, knowledge, answer style, interfaces, response speed, quality, limits, and integrations may change. Access is to the then current experience during the applicable entitlement period, not to a permanently fixed feature set.

3. Artificial intelligence limitations

3.1 Garry AI outputs are generated by probabilistic systems. They may be incomplete, inaccurate, inconsistent, outdated, offensive, unexpected, or unsuitable. Similar or identical outputs may be produced for other users.

3.2 Numerology, astrology, timing, compatibility, sports, market, relationship, and personal guidance are interpretive and do not promise any result. You are responsible for independently evaluating information and for every decision, action, transaction, wager, communication, or omission based on an output.

3.3 Garry AI is not a substitute for medical, mental health, legal, tax, accounting, investment, financial, gambling, emergency, or other licensed or regulated advice. Do not delay professional help, place a wager, make an investment, or take another high consequence action solely because of an output.

3.4 CUE does not guarantee that an output reflects Gary’s present personal opinion, would be the response Gary would give in a private setting, or remains consistent across users, models, sessions, or time.

4. Offers, billing, and automatic renewal

4.1 Garry AI may be offered separately, with CUE Plus, or through public, member, Academy, sponsored, promotional, or other plans. The checkout screen controls the specific price, billing interval, included products, credit allocation, eligibility, trial, renewal, tax, and other purchase terms.

4.2 Unless checkout clearly states otherwise, a Garry AI subscription renews automatically at the interval and price shown at checkout until cancelled. You authorize the applicable payment provider to charge each renewal when due.

4.3 Cancel through the same purchase channel or another method CUE expressly provides. Cancellation stops future renewals and normally leaves access active through the paid term. It does not automatically create a refund.

4.4 Apple, Google, Stripe, or another payment provider may control billing administration, cancellation, and refunds. The CUE Fulfillment Policy and Cancellation Policy provide additional channel specific terms.

5. Credits and cost based consumption

5.1 A Garry AI plan may provide a credit allocation, access budget, or other measurable entitlement. It does not provide a fixed or unlimited number of messages, calls, responses, voice minutes, prompts, or model requests unless the live checkout screen expressly says otherwise.

5.2 Credits are consumed according to the actual or estimated cost and resources required to process a request. Relevant factors may include the selected model, provider pricing, input size, output size, conversation context, reasoning effort, voice duration, speech generation, tools, retrieval, media, premium features, and other computing resources.

5.3 Different requests may consume different amounts of credit even when they appear similar. A longer, more complex, voice enabled, tool enabled, or premium model request may consume substantially more credit than a shorter standard request.

5.4 CUE may display an estimate before processing and the final charge afterward. Estimates, balances, and usage records may be delayed, rounded, corrected, or adjusted for processing failures, duplicate activity, provider reporting, refunds, fraud, or technical error.

5.5 Unless the applicable offer states otherwise, unused recurring plan credits do not roll over and reset or expire at the end of the applicable allocation period. Purchased, promotional, sponsored, trial, or goodwill credits may have different expiration and use rules disclosed when issued.

5.6 Credits have no cash value, are not legal tender, and are personal, nontransferable, and nonrefundable except where required by law or expressly stated in the offer. A credit balance does not create ownership of provider capacity or a right to convert credits into money.

6. Changes to credit rates and allocations

6.1 CUE may set and prospectively adjust credit allocations, consumption rates, included models, feature costs, rounding, minimum charges, maximum request sizes, and related rules as provider pricing, model capability, abuse patterns, and operating costs change.

6.2 A change may cause the same type of request to consume more or fewer credits in the future. CUE is not required to maintain a permanent conversion between one credit and a message, token, minute, dollar amount, or model call.

6.3 CUE will provide notice or obtain consent before a material change to a current paid entitlement when required by law or marketplace rules. Changes may apply immediately when reasonably necessary to address security, fraud, legal requirements, provider discontinuation, critical capacity, or a clear pricing or technical error.

6.4 CUE may add lower cost modes, premium modes, optional top ups, higher capacity plans, or separate charges. Availability and pricing are controlled by the then current offer and are not guaranteed.

7. Fair use and service capacity

7.1 Every Garry AI plan and credit balance is subject to fair use. Having unused credits does not create an unconditional right to unlimited speed, concurrency, automation, continuous processing, provider capacity, or access that threatens service integrity.

7.2 CUE may apply reasonable rate, concurrency, safety, security, model, feature, regional, provider, and capacity limits. CUE may slow, queue, pause, downgrade, or temporarily restrict use that is materially above normal individual use, creates unusual cost or load, resembles automation or spam, disrupts other users, threatens stability, or attempts to avoid product controls.

7.3 Fair use controls may consider request frequency, concurrency, session length, cost, device and network patterns, account sharing, automated behavior, repeated retries, capture activity, provider limits, and related signals. A fair use restriction does not necessarily mean misconduct occurred.

7.4 CUE is not required to publish internal thresholds, average usage data, detection logic, provider cost, capacity rules, or security methods. If legitimate personal use appears excessively limited, contact [email protected]. CUE may review the account and may restore access, adjust limits, recommend another plan, or offer an additional capacity arrangement.

7.5 Fair use operates independently from credits. CUE may restrict abusive or destabilizing activity even when credits remain, and exhausted credits may stop paid processing even when the activity would otherwise satisfy fair use.

8. Eligibility, tiers, and access

8.1 Access, pricing, credit allocation, models, prompt availability, knowledge levels, and features may depend on verified CUE, CUE Plus, Lifetime, GG33 Academy, Bronze, Silver, Gold, Diamond, sponsored, or other status.

8.2 CUE may verify eligibility and may correct, lock, suspend, downgrade, or remove an offer or access level granted in error or obtained through false, incomplete, outdated, or unauthorized information.

8.3 A separate Garry AI entitlement may continue through its paid term if another CUE membership ends, unless the offer expressly requires continuing membership or eligibility. Access to one tier does not grant access to another tier or permission to copy or disclose restricted knowledge.

9. Refunds and first use

9.1 Because Garry AI provides immediate digital processing and generated output, a Garry AI purchase is generally nonrefundable after any paid feature is accessed or used, including a paid response, voice interaction, premium prompt, restricted prompt, restricted knowledge feature, sports content, market content, or consumption of paid credits.

9.2 Before first paid use, refund eligibility depends on the purchase channel, offer terms, request timing, and applicable law. Apple and Google purchases follow the marketplace process. Eligible website requests are reviewed under the CUE Fulfillment Policy.

9.3 Cancellation, plan change, depleted credits, changed usage patterns, account deletion, dissatisfaction with a generated answer, or a fair use restriction does not automatically create a refund, extension, or replacement credit. CUE will provide any remedy required by applicable law.

9.4 A refund, chargeback, payment reversal, or invalidated transaction may remove the related subscription, credits, content, and access. A user may not retain both reimbursement and the corresponding digital value.

10. Voice processing

10.1 Voice features may use ElevenLabs and other approved providers to process raw audio and generate spoken output for the active interaction. Raw audio is deleted after processing.

10.2 CUE does not create or retain a transcript or chat history from a voice session. Limited metadata concerning time, feature usage, cost, diagnostics, safety, and security may be retained without retaining raw audio or a voice transcript, as described in the Privacy Policy.

10.3 Do not submit another person’s voice without every permission required by law. Voice features may not be used for unauthorized identification, impersonation, surveillance, deception, harassment, or violation of another person’s rights.

11. Privacy, providers, and human review

11.1 OpenAI, OpenRouter, and approved routed model providers may process prompts, relevant CUE profile context, calculated values, instructions, and outputs needed to provide Garry AI. These providers are not permitted to use CUE conversation data to train their general models.

11.2 Selected saved text conversations may be accessed only by authorized CUE developers and personnel for support, troubleshooting, safety, quality evaluation, and improvement of the CUE user experience. Private conversations are not disclosed to unauthorized persons and are not used for provider model training.

11.3 CUE may process account, membership, purchase, credit, cost, device, usage, consent, security, and saved conversation information as described in the CUE Privacy Policy. Gary, 28 STREET LLC, GG33, Academy personnel, and other outside parties do not receive independent ownership of CUE customer accounts, contact lists, private conversations, or customer databases.

11.4 Before information is sent to an artificial intelligence provider, CUE provides the notice and obtains the permission required by applicable law or platform rules. Do not submit information you do not want processed for the requested feature.

12. Communications

12.1 CUE may send account, purchase, renewal, credit, security, legal, support, and service communications necessary to operate Garry AI.

12.2 Promotional calls and text messages require separate consent where required. Creating an account, accepting these Product Terms, or making a purchase does not by itself authorize automated promotional calls or texts.

12.3 Where separately authorized, promotional messages may concern CUE, Garry AI, product updates, and offers. Consent is optional and is not required to purchase. Message and data rates may apply, and users may opt out through the method stated in the message.

13. Acceptable use

13.1 Use Garry AI only for lawful personal purposes and any other use expressly authorized in writing. You may not use the product to harm, threaten, defame, harass, exploit, deceive, impersonate, surveil, discriminate against, or violate the rights of Gary, CUE personnel, another user, or any person.

13.2 You may not intentionally manipulate Garry AI to create fabricated, misleading, unlawful, defamatory, sexually exploitative, hateful, violent, or out of context material for publication, ridicule, reputational harm, false attribution, fraud, or abuse.

13.3 You may not represent an output as a direct statement, personal communication, endorsement, guarantee, prediction, promise, or approval from Gary unless CUE expressly identifies it as such in writing.

13.4 You may not use Garry AI for illegal gambling activity, unlawful financial promotion, market manipulation, fraud, deceptive advertising, or a decision prohibited from automated processing by applicable law.

14. Prohibited technical conduct

14.1 You may not jailbreak, inject prompts, manipulate, trick, socially engineer, or repeatedly probe Garry AI to defeat safeguards, reveal hidden instructions, access another tier, or produce prohibited or falsely attributed content.

14.2 You may not gain unauthorized access to accounts, databases, prompts, instructions, source materials, restricted knowledge, models, configurations, security controls, payment systems, or infrastructure.

14.3 You may not scrape, crawl, mirror, archive, bulk download, reverse engineer, reconstruct, reproduce, republish, resell, sublicense, or create a competing or derivative product from Garry AI, its protected interfaces, its proprietary materials, or restricted outputs.

14.4 You may not use bots, scripts, automated agents, artificial intelligence systems, bulk requests, spam, denial of service methods, or other automated means to query, test, train on, overload, probe, manipulate, or interfere with Garry AI without prior written authorization.

14.5 You may not circumvent pricing, credits, membership tiers, authentication, fair use controls, rate limits, screenshot controls, moderation, safety, or security measures, or share, sell, transfer, or permit unauthorized use of an account or entitlement.

14.6 You may not use Garry AI prompts, outputs, recordings, conversations, restricted knowledge, or proprietary materials to train, evaluate, improve, benchmark, or operate another artificial intelligence system or competing product without prior written authorization.

14.7 Attempting, directing, encouraging, coordinating, or assisting prohibited conduct is a violation whether or not the attempt succeeds.

15. Capture, sharing, and confidentiality

15.1 Garry AI contains licensed personality rights, proprietary prompts, restricted prompts, restricted knowledge, confidential methods, and protected CUE intellectual property. Access is personal and limited.

15.2 You may not screenshot, screen record, photograph, copy, mirror, capture, externally transcribe, download, stream, broadcast, post, upload, publish, transmit, display, distribute, sell, or otherwise share protected Garry AI conversations, prompts, outputs, voice interactions, sports content, market content, interfaces, or restricted knowledge without prior written permission from CUE.

15.3 CUE may block, obscure, detect, watermark, log, or respond to capture activity. A contractual restriction applies even if a technical control is unavailable, bypassed, or imperfect.

15.4 Any stricter confidentiality, access, or membership terms presented for a restricted tier, prompt, knowledge set, or added benefit also apply. If those terms conflict on the protected item, the stricter specific terms control to the extent permitted by law.

16. Name, image, voice, and promotion

16.1 Access does not grant any right to use Gary S. Grinberg’s name, image, voice, likeness, persona, biography, reputation, trademarks, identity, or endorsement in advertising, social content, merchandise, websites, applications, demonstrations, or commercial activity.

16.2 Only parties with current written authorization may publicly promote or demonstrate Garry AI using Gary related materials. Authorized parties must follow the approval scope and use only approved assets, statements, disclosures, and campaign materials.

16.3 You may not imply that Gary, Garry AI, GG33, 28 STREET LLC, or CUE sponsors, endorses, employs, partners with, or is affiliated with you, your account, or a product or service without written authorization.

17. User input and generated output

17.1 You retain rights you lawfully hold in information you submit. You grant CUE the rights described in the CUE Terms and Privacy Policy to process inputs for service delivery, personalization, security, support, legal compliance, and authorized improvement purposes.

17.2 Subject to the CUE Terms, your compliance, and third party rights, CUE permits you to use ordinary personal outputs for your private, noncommercial purposes. This permission does not transfer ownership of Garry AI, Gary related materials, CUE methods, restricted knowledge, prompts, interfaces, trademarks, or other underlying intellectual property.

17.3 Outputs may not be unique. CUE and its licensors retain all rights in the service, protected materials, selection, arrangement, systems, and improvements. No output grants permission to violate another person’s privacy, publicity, intellectual property, contractual, or other rights.

18. Monitoring and enforcement

18.1 CUE may use automated and authorized human review tools to detect fraud, malicious automation, spam, scraping, account sharing, prompt extraction, abnormal use, capture attempts, safeguard evasion, payment misconduct, and other violations.

18.2 CUE may warn, throttle, queue, restrict, suspend, downgrade, or permanently terminate access, with or without advance notice where permitted, when CUE reasonably believes activity is abusive, fraudulent, malicious, automated, unlawful, unauthorized, reputationally harmful, security threatening, materially violative, or creates an unreasonable service burden.

18.3 Enforcement may apply to reasonably connected accounts, devices, phone numbers, email addresses, payment methods, networks, and identifiers. CUE is not required to disclose detection methods, internal thresholds, evidence, or investigation procedures except where law requires disclosure.

19. Preservation and remedies

19.1 CUE may preserve account, prompt, saved conversation, device, network, usage, cost, payment, capture, and security records when reasonably necessary to investigate misconduct, protect rights or users, comply with law, respond to legal process, enforce agreements, or pursue remedies.

19.2 CUE may cooperate with payment providers, technology providers, cybersecurity professionals, legal counsel, courts, regulators, and law enforcement where legally permitted and reasonably necessary.

19.3 CUE and its licensors reserve every available contractual, intellectual property, trade secret, publicity, privacy, computer crime, unfair competition, injunctive, damages, and other remedy. Enforcement of one remedy does not waive another.

20. Availability and product changes

20.1 CUE may add, remove, modify, test, replace, suspend, or discontinue models, providers, features, prompts, knowledge, limits, interfaces, or integrations. CUE does not guarantee uninterrupted availability, a specific provider or model, a particular answer style, or access to a particular feature.

20.2 Security, legal, safety, provider, capacity, technical, cost, or operational needs may require immediate changes. For a material change to a current paid entitlement, CUE will provide the notice or remedy required by law or marketplace rules.

20.3 Temporary outages, provider errors, queues, maintenance, output dissatisfaction, or reasonable fair use limits do not automatically create a refund right. CUE may provide restoration, replacement credits, extensions, or other support remedies at its discretion unless law requires a specific remedy.

21. Account deletion

21.1 Deleting a CUE account terminates Garry AI access associated with that account and may remove unused credits where permitted by the applicable offer and law. Account deletion is not a cancellation or refund event.

21.2 Deleting an account does not automatically cancel an Apple, Google, Stripe, or other subscription. Cancel through the original purchase channel before completing account deletion.

21.3 Personal information is deleted or deidentified according to the CUE Privacy Policy, subject to records retained for billing, fraud prevention, security, disputes, legal obligations, consent, enforcement, and legal claims.

22. Relationship to the CUE Terms

22.1 The CUE Terms of Service are incorporated into these Product Terms. Their provisions concerning age and eligibility, accounts, payments, intellectual property, user content, disclaimers, liability limitations, indemnification, dispute resolution, arbitration, governing law, regional consumer rights, and general legal terms also apply to Garry AI.

22.2 If any provision is unenforceable, it will be limited or severed to the minimum extent necessary, and the remaining provisions continue in effect. A failure to enforce a provision is not a waiver.

23. Changes and acceptance

23.1 CUE may update these Product Terms as Garry AI, providers, pricing, credits, fair use controls, laws, and risks change. The revised terms will display a new effective date.

23.2 CUE will provide notice of material changes through the application, email, website, checkout flow, or another reasonable method and will request acceptance or consent where required. CUE may present an update notice for acceptance when the application opens.

23.3 Continued access after the effective date of a properly disclosed update constitutes acceptance to the extent permitted by law. A change will not retroactively remove a nonwaivable consumer right.
